We have jurisdiction under Article V, Section 4(2) of the Florida Constitution, F.S.A. and Rule 4.5(c)(6) of the Florida Appellate Rules, 32 F.S.A., because that decision conflicts with Brown v. State, Fla.1968, 206 So.2d 377.
